- Install and use VitalBlink on your server infrastructure
- Use the Software for hospital management purposes within your facility
- Create unlimited user accounts for your staff
- Receive software updates and security patches
2.2 License Restrictions
- You may not distribute, sell, lease, or sublicense the Software
- You may not reverse engineer, decompile, or disassemble the Software
- You may not remove or alter any proprietary notices or labels
- You may not use the Software to provide services to third parties
3. Pricing and Payment
3.1 One-Time Purchase
VitalBlink is sold as a one-time purchase with no recurring subscription fees. The license fee includes:
- Perpetual license to use the Software
- Lifetime software updates and security patches
- Email support for technical issues
- Access to documentation and resources
3.2 Refund Policy
We offer a 30-day money-back guarantee. If you are not satisfied with VitalBlink, contact us within 30 days of purchase for a full refund. Refunds are provided at our discretion and may require explanation of issues encountered.
4. Updates and Support
4.1 Software Updates
We provide free lifetime updates including new features, improvements, and security patches. Updates are optional but recommended for optimal performance and security.
4.2 Technical Support
We provide email-based technical support for installation, configuration, and troubleshooting. Support response times:
- Critical issues: 24-48 hours
- General inquiries: 3-5 business days
- Support available Monday-Friday, 9 AM - 6 PM EST
5. User Responsibilities
As a user of VitalBlink, you are responsible for:
- Compliance: Ensuring your use complies with applicable healthcare regulations (HIPAA, GDPR, local laws)
- Data Security: Implementing appropriate security measures to protect patient data
- Backups: Maintaining regular backups of your database and critical files
- Infrastructure: Providing adequate server resources and network infrastructure
- User Training: Ensuring your staff is properly trained to use the Software
- License Compliance: Using the Software only as authorized by these Terms
6. Warranties and Disclaimers
6.1 Limited Warranty
We warrant that the Software will perform substantially in accordance with the documentation for 90 days from the date of purchase. Our sole obligation under this warranty is to use reasonable efforts to correct documented defects.
6.2 Disclaimer
EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that the Software will be uninterrupted or error-free
- Warranties regarding medical advice or clinical decision-making
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you for the Software
- We are not liable for data loss, system downtime, or business interruption
- We are not liable for medical decisions or patient care outcomes
Note: VitalBlink is a management tool only. All medical decisions and patient care remain the responsibility of qualified healthcare professionals.
8. Termination
This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with these Terms. Upon termination:
- You must cease all use of the Software
- You must uninstall all copies of the Software
- Provisions regarding warranties, liability, and proprietary rights survive termination
9. General Provisions
9.1 Governing Law
